TERMS AND CONDITIONS FOR THE SALE OF GOODS ON THE AUSWORKWEAR & SAFETY WEBSITE

These Terms and Conditions form a contract between you (the "Customer") and Ausworkwear & Safety Pty Ltd (ABN 85 004 688 475), and apply to the ordering, purchase, fulfilment, and delivery of goods from ausworkwear.com.au via the website or telephone.

By submitting an online order or placing an order via telephone, you agree to be bound by the following Terms and Conditions.

Please read these Terms and Conditions carefully before placing your order, as they contain important information about ordering, processing, fulfilment, delivery, and limitations of liability.

By browsing our website or placing an order, you agree to these Terms and Conditions, forming a legally binding agreement between you and Ausworkwear & Safety. Your order, together with these Terms and Conditions, constitutes the entire agreement for the supply of products and/or services.

These Terms cannot be modified unless agreed in writing by Ausworkwear & Safety. Where these terms conflict with our Trading Terms or Account Terms and Conditions of Supply, those documents shall prevail.

1. DEFINITIONS

Key terms include:

  • Goods – Products offered for sale via ausworkwear.com.au

  • Delivery Fee – Fee charged for shipping, calculated at checkout

  • Price – The product price as displayed online (inclusive of GST unless otherwise stated)

2. COMPLIANCE WITH TERMS AND CONDITIONS

2.1 By submitting an order, you agree to be bound by these Terms and Conditions.
2.2 Each order forms a separate agreement between you and Ausworkwear & Safety.

 

3. PLACING ORDERS FOR GOODS

3.1 Orders must be submitted via our online order form.
3.2 Your order constitutes an offer to purchase. It cannot be withdrawn without our consent.
3.3 Orders are for personal and domestic use only. Quantity limits may apply.
3.4 You are responsible for providing accurate and complete information.
3.5 Orders must be placed by individuals aged 18+ with a valid email and phone number.
3.6 Orders may only be cancelled or changed by agreement. Returns are accepted as per our Returns Policy.
3.7 Orders over $2,000 (excl. GST) may require approval.
3.8 An order number will be provided after checkout.
3.9 You are responsible for keeping your login credentials secure.

 

4. ACCEPTANCE AND REJECTION OF ORDERS

4.1 We reserve the right to reject any order.
4.2 If accepted, the order forms a binding agreement.
4.3 If rejected, you will be notified within 5 business days.
4.4 Refunds (if applicable) will be processed within 7 business days.
4.5 If we cannot contact you after reasonable attempts, the order may be cancelled.
4.6 Orders may be withheld if items are out of stock, discontinued, or your account is overdue.

 

5. AVAILABILITY OF GOODS

5.1 Occasionally, items may be out of stock. You will be contacted within 5 business days.
5.2 We reserve the right to withdraw items from sale at any time.
5.3 Errors in price or description will result in rejection or partial fulfilment, with the option to cancel.
5.4 Images are for illustration only. Sizes, colours, and accessories may vary.

 

6. PRICE AND PAYMENT

6.1 Prices are as listed on the Website.
6.2 Prices are in AUD and inclusive of GST unless otherwise stated.
6.3 Prices may change at any time unless already ordered.
6.4 You agree to pay the price and any delivery fees.
6.5 Payment methods accepted: Credit Card, PayPal, and Afterpay.
6.6 Goods will not be dispatched until payment is received.
6.7 You warrant that you have not engaged in any fraudulent activity.
6.8 A confirmation and tax invoice will be issued via email.
6.9 We use SSL encryption and PCI DSS-compliant providers to protect your payment. We do not store card data. While precautions are taken, we cannot guarantee the security of all transactions.

Note: Online pricing may vary from in-store pricing, particularly across our QLD and NSW retail locations. We reserve the right to adjust pricing and promotional offers independently across channels.

 

7. DELIVERY

7.1 Your delivery details will be provided to the Delivery Agent.
7.2 Fees are outlined in our Shipping & Returns section.
7.3 Estimated delivery timeframes are indicative only.
7.4 Delivery delays may occur due to unforeseen circumstances.
7.5 Delivery occurs at the address provided at checkout.
7.6 If delivery fails due to inaccessibility or incorrect information, redelivery fees may apply.
7.7 If uncollected within 10 business days, you must contact us for reissue.
7.8 Inspect your goods on delivery. Damaged or incorrect items must be reported promptly.
7.9 We reserve the right not to ship to certain remote areas.

 

8. RISK AND TITLE

Risk and title transfer to you upon delivery to the Delivery Agent.

 

9. ORDER CANCELLATIONS AND RETURNS

9.1 Orders cannot be cancelled once submitted unless otherwise agreed.
9.2 Returns must comply with our Returns Policy. Items must be in original condition with tags attached.
9.3 Refunds (where applicable) will be processed within 7 business days.
9.4 Refunds must be processed to the original payment method.
9.5 Custom orders, embroidered, tailored, screen-printed, worn, or special-buy goods are non-refundable unless required under Australian Consumer Law.

 

10. PROMOTIONS AND DISCOUNTS

Codes must be entered at checkout and cannot be applied retrospectively. Promotional offers may not apply to sale items and cannot be combined with other offers unless specified.

 

11. GIFT CARDS

11.1 Additional conditions may be published on our website.
11.2 Treat Gift Cards like cash. Lost or stolen codes will not be replaced.
11.3 Gift Cards expire 12 months from issue.
11.4 Maximum $500 per card, $2,000 per order limit applies.

 

12. PRIVACY

We handle personal information in accordance with our Privacy Policy. Your data will not be sold to third parties.

 

13. WEBSITE TERMS

Use of our website is subject to the Website Terms, which form part of these Terms and Conditions.

 

14. WARRANTIES YOU MAKE TO AUSWORKWEAR & SAFETY

You warrant that:

  • All information provided is accurate and up to date.

  • Any nominated recipient has consented to share their information.

  • You are over 18 years of age.

  • You have read and understood these Terms and Conditions.

  • You comply with all applicable laws.

 

15. AUSWORKWEAR & SAFETY'S LIABILITY TO YOU

15.1 Except where required under law, we are not liable for indirect or consequential loss.
15.2 Statutory consumer rights apply and cannot be excluded.
15.3 Our liability will be reduced to the extent you caused or contributed to the loss.

 

16. TERMINATION

We may suspend or cancel your account or access to the website:

  • At any time for convenience (with notice), or

  • Immediately if you breach these Terms and fail to remedy it within 14 days.

 

17. GENERAL

17.1 We may amend these Terms and Conditions at any time by updating the Website.
17.2 Notices may be sent via email.
17.3 If a clause is unenforceable, it will be severed without affecting the rest.
17.4 Failure to exercise a right is not a waiver of that right.
17.5 These Terms are governed by the laws of Victoria, Australia, and your transaction is deemed to take place in Morwell, VIC.
